Important terms and license terms for using Aura.

These Terms of Use and End User License Agreement apply to the Aura iOS app, this marketing site, and related content and services we make available. By accessing or using Aura, you agree to these terms. If you do not agree, do not use Aura.

Who These Terms Apply To

These terms apply to your use of the Aura app, the Aura website, and any related features, content, and support channels we provide. If you use Aura on behalf of another person or organization, you represent that you are authorized to accept these terms for them.

Aura is operated by Daniel Williams, a sole trader. In these terms, "Aura," "we," "us," and "our" refer to Daniel Williams as the provider of Aura.

You may use Aura only if you can form a binding agreement with us and your use is permitted by applicable law.

You must be at least 13 years old to use Aura. If you are under the age of majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these terms on your behalf.

License And Acceptable Use

Subject to these terms, Aura gives you a limited, revocable, non-exclusive, non-transferable license to use the app and website for your personal, non-commercial use.

You agree not to:

  • Copy, sell, rent, sublicense, or commercially exploit Aura or its content.
  • Reverse engineer, decompile, or try to extract source code except where applicable law permits it.
  • Interfere with the normal operation, security, or integrity of Aura.
  • Use Aura in any way that violates law or infringes another person's rights.

Apple App Store Terms

If you download Aura through the Apple App Store, this agreement is concluded between you and Daniel Williams only, and not with Apple. Daniel Williams, not Apple, is solely responsible for Aura and its content.

Your license to the Aura app is limited to a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and applicable Usage Rules, except that Aura may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where permitted by Apple.

Daniel Williams is solely responsible for providing any maintenance and support services for Aura. Apple has no obligation whatsoever to furnish any maintenance or support services for Aura.

To the extent any warranty is not effectively disclaimed under these terms or applicable law, Daniel Williams is solely responsible for that warranty. If Aura fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, paid for the app. To the fullest extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to Aura.

Daniel Williams, not Apple, is responsible for addressing any claims by you or any third party relating to Aura or your possession and use of Aura, including product liability claims, claims that Aura fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar laws.

In the event of any third-party claim that Aura or your possession and use of Aura infringes that third party's intellectual property rights, Daniel Williams, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that intellectual property claim.

You represent and warrant that you are not located in a country that is subject to a U.S. government embargo or designated by the U.S. government as a terrorist-supporting country, and that you are not listed on any U.S. government list of prohibited or restricted parties.

You must comply with applicable third-party terms when using Aura, including the Apple Media Services Terms and Conditions and any applicable wireless data service or device terms.

Apple and Apple's subsidiaries are third-party beneficiaries of these terms and, upon your acceptance of them, will have the right to enforce these terms against you as a third-party beneficiary.

Subscriptions And Purchases

Aura may offer premium features, subscriptions, or other paid content through Apple's App Store. Billing, renewals, and cancellations for App Store subscriptions are handled by Apple and are also subject to Apple's applicable terms and policies.

Unless otherwise required by law or Apple's policies, payments are non-refundable once charged. You can manage or cancel your subscription through your Apple account settings.

If you purchase an auto-renewing subscription, it will renew automatically unless auto-renew is turned off at least 24 hours before the end of the current billing period. Apple may charge your account for renewal within 24 hours before the end of the current billing period.

Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable. We may change subscription prices for future renewal periods in accordance with Apple's policies, and Apple may notify you or request your consent when required.

Third-Party Services And Platforms

Aura may rely on third-party platforms and service providers to operate certain features, including Apple, RevenueCat, analytics providers, and other infrastructure or support tools. Your use of those third-party services may also be subject to their own terms, policies, and platform rules.

Aura may also contain links to third-party websites or services we do not own or control. To the fullest extent permitted by law, we are not responsible for third-party content, availability, or practices.

Wellness Content Only; Not Medical Advice

Aura provides mindfulness, meditation, breathwork, sleep, and wellness content for general informational and self-care purposes only. Aura is not a medical provider, mental health provider, therapist, clinic, or emergency service, and Aura is not a medical device.

Aura does not diagnose, treat, cure, or prevent any disease, condition, or mental health issue, and nothing in Aura should be treated as medical advice, diagnosis, treatment, or a substitute for professional care. Always use your own judgment and consult a qualified healthcare professional about any medical or mental health questions.

Safety And Emergency Disclaimer

Some Aura content may involve breathing patterns, guided rest, or other relaxation practices that are not appropriate for everyone. Do not use Aura while driving, cycling, operating machinery, in water, or while doing anything that requires your full attention.

If you feel pain, dizziness, lightheadedness, distress, shortness of breath, or any other discomfort while using Aura, stop immediately and seek appropriate professional help.

Before using breathwork or similar guided breathing practices in Aura, consult a qualified healthcare professional if you have a cardiovascular condition, respiratory condition such as asthma or COPD, epilepsy or a history of seizures, are pregnant, or have a history of panic attacks, dissociation, or other conditions that could be affected by breathing exercises.

Aura does not provide crisis counseling, clinical monitoring, or emergency response. If you think you may be having a medical or mental health emergency, call your local emergency services immediately or contact a qualified emergency provider right away.

Availability, Updates, And Changes

We may update, change, suspend, or discontinue any part of Aura at any time, with or without notice. We do not guarantee that Aura or any specific feature, piece of content, or integration will always be available, uninterrupted, secure, or error-free.

Warranty Disclaimer

To the fullest extent permitted by law, Aura is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.

We disclaim, to the fullest extent permitted by law, any warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, and that Aura will meet your needs or produce any particular wellness or health outcome.

We do not warrant that Aura will be uninterrupted, secure, error-free, or that any content, recommendations, or other information made available through Aura will be complete, accurate, or suitable for your situation.

Limitation Of Liability

To the fullest extent permitted by law, Aura will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, goodwill, revenue, or profits, arising out of or related to your use of, or inability to use, Aura.

To the fullest extent permitted by law, Aura's total liability for any claim arising out of or relating to Aura or these terms will not exceed the greater of the amount you paid for Aura in the 12 months before the event giving rise to the claim or US$100.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these terms limits liability to the extent such liability cannot be limited under applicable law.

Nothing in these terms affects any statutory consumer rights or remedies you may have under applicable law that cannot be waived or limited.

Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless Aura and its owners, operators, affiliates, licensors, and service providers from claims, losses, liabilities, damages, and expenses, including reasonable attorneys' fees, arising out of or related to your misuse of Aura, your violation of these terms, or your violation of another person's rights or applicable law.

Intellectual Property

Aura, including its app, website, text, audio, visuals, branding, design, and software, is protected by intellectual property laws and remains owned by Aura or its licensors. These terms do not give you ownership of Aura or any of its content.

If you choose to send feedback or suggestions, you allow us to use them without restriction or compensation to you.

Privacy

Your use of Aura is also subject to our Privacy Policy.

Termination

We may suspend or terminate your access to Aura if we believe you have violated these terms, created risk for us or others, or used Aura unlawfully. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnity, and dispute-related provisions.

Changes To These Terms

We may update these terms from time to time. When we do, we will post the updated version here and revise the "Last updated" date above. By continuing to use Aura after updated terms become effective, you agree to the revised terms.

Force Majeure

We will not be liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, internet or telecommunications failures, platform outages, or governmental actions.

Severability

If any provision of these terms is found to be invalid, unenforceable, or unlawful, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.

Entire Agreement

These terms, together with our Privacy Policy, form the entire agreement between you and Aura regarding your use of Aura, except where Apple's applicable platform terms or other mandatory legal terms also apply.
